Mother Indian citizen and visited US for less than 6 months can i claim her dependent

Hello there,

While reading the forum on this website, i saw you helped many people with their complicated queries about tax returns.

I would appreciate if you can respond to this query. Thanks~

My Mother came to US on May 13 2007 and left US on 6th oct 2007. She is came here on Visitor Visa and she is Indian Citizen. I paid for all her stay in US and also she is not earning any thing in India and she is NOT claimed on any tax returns in india.

Can i claim her as dependent on my 2007 tax returns.

Thanks much
Mayank

No, you cannot.

She must be resident in the U.S. for at least 183 days to be claimed as a dependent.

There are three requirements:
1. The dependent must be a U.S. citizen or resident.
2. You must have provided more than half of the support for the year.
3. She must not earn more than $3,400 in 2007.
