L1 Visa Tax Filing

Hi,

I and my spouse are on L1-B visa.
We started work in USA in mid Oct 2006 for 2.5 months till Dec 2006.

1. Are we Non Resident Aliens for 2006 ?

2. Are Social Security and Medicare taxes applicable for Non Resident Aliens (L visa) ?

3. We have a child who was not issued a SSN when we initially came in.
Are dependants of L1-B not issued a SSN ? Do we then apply for a ITIN for our child ?

4. What kind of relocation expenses are eligible for tax exemption ?

1) Yes, you are non-resident aliens unless you choose to be treated as resident aliens. If you make that choice, you must wait until you meet the Substantial Presence Test in 2007 (sometime in June 2007).

2) Yes, regardless of how you file.

3) The child will need an ITIN. File Form W-7 with a notarized photocopy of his/her passport.

4) Some of the expenses are deductible, but it is limited.

Do you have any references for Tax Consultants in Bay Area, who are familiar with situations as in my case and can file our returns ?

No, but you can access the NATP website (National Association of Tax Professionals) for a listing of their members.

Call and ask if they have experience in working on tax returns for foreign nationals.
