IRS rejected my taxes because someone claimed my son

i e-filed my taxes this year only to find out that it was rejected by the irs because someone has claimed my son...how can i find out who and can i prosecute?!

Try calling the IRS. Once you convince them that your son is in fact your son and that you have the right to claim his exemption, they IRS should be able to tell you who claimed him.

As for prosecuting, leave that to the IRS.

Very true, and it may take a certified letter to them stating they are in error and that you wish to re-submit your tax return and ask them what proof they would like to show that your son is indeed with you and that he is your exemption.

Since they go by SS number, it could be someone else claimed a chid and had an error with the thier SS number. Also check to be sure you did have the correct SS number on your tax form.

You also may want to be sure someone has not stolen your identity ( not as likely but you never know)

Also are you divorced and if so could your ex have claimed the child.
