    Insolvent Chapter 7 and Taxes
    I e-filed with H & R Block and informed them I had a discharged bk April last year. She asked for my 1099c's. I told her I hadn't received anything yet. She said they usually run a year behind and I will have to file them with next years taxes. My refund has been taking a long time so I was looking up things online to as why. I just found out if you haven't a 1099c you are suppose to file form 982 and I can't find one in my return copy that she prepared. What do I do, go back to H & R Block and have them fix it on an amend. I don't want to get in trouble for H & R Blocks error. I filed Jan 30th with direct deposit and it is now Mar 11th.

    This is clearly H&R Block's error, so go back to them to get it fixed at no charge to you!

    One more question, I never received any discharge papers, 1099's or any information on what and to whom was discharged as I reaffirmed about 1/2 my debt. Where do I get this information? I thought I would have been mailed at least the discharge papers or something to file with my taxes.

    I agree, you should have gotten something.

    I recommend you contact the lawyer who helped you with the bankruptcy.

    If you are discharged, then you get a discharge letter from the court.

    Your attorney and you should have all gotten them.

    I left a message last night with my attorney to send me the discharge papers. I hope I get them soon so I don't get any penalties or fines. Thank you for your help.
