    Indian HIB eligible deductions and is it OK to do 1099 consulting while on W2?
    Hello:

    I am confused over two points.

    1) I am on H1B visa from India, here 2 years. My tax was done by IBSN. I am a W2 employee at a major US corp. I drive commuting miles and pay rent, have no other unreimbursed employee expenses.

    My tax returns lists deductions for laundry, rental fees, meals and ent, and commuting mileage. Is this correct?

    2) I wish to open a part time computer consulting company on the side. Is this allowed under the visa rules while being a W2 employee. If so, can someone please tell me the section of code.

    1. Your are working on H1-B for two years. You can't deduct laundry, rental, means and commuting miles.

    2. If you can do business besides normal W2 job, normally no. Your H1-B is approved for a particular employer.
    Why do you need the info on the section of code to start a business?

    I thought if I could open a business on the side, I would need the code section if IRS ever audit me.

    How can I open business on the side in US, through wife H4 status?

    If wife had H1 status, and is not working, could I open business consult under her number?

    If your employer does not have any objection, you may do it. You don't need business code to start a business.
    The business income is reported on schedule C (form 1040). In this you will enter type of business and its code. Schedule C instructions has the list.
