Have applied for ITIN but how to file state tax

Hi,

I have applied for ITIN for my spouse with my federal tax. Last year i had income from California and New Jersey. IN NJ they ask me to send copies of W7 form and federal taxes with NJ tax return.

But i am not sure about California? Can i do same thing with california return?

Thanks for your help in advance.

-Nilay

Nilay:

Many states ask for the federal tax return as a matter of routine, but I am surprised that they want to see the W-7. Maybe they will corrdinate with the IRS directly and get the ITIN when it is issued.

I would just hold on to BOTH state returns and file them only after you got the ITIN back. If you have refunds coming from both, there will be no penalty for filing late.
