F1 OPT to h1b 2008 tax form

Hi:

I came to USA on Aug, 10, 2004. In 2008 tax year, I was on OPT till Sep 30, and my h1 started on Oct 1. I left to India on Oct 17, 2008 and came back to USA on Feb 17, 2009.

Should I file 1040 NR EZ or 1040 EZ.
Am I eligible for $600 Tax Credit.

Regards,
Prashanth

You will file nonresident tax return and Form 8843. If you have income during F1/OPT you will get treaty deduction. Read: Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents
