F1 to H1 -> how to pay social security for H1 earnings.

Hi,
I was working on my OPT (F1) till September '04 and then switched to H1. My employer did not withhold social security and medicare from my salary for the 3 months from October thru December of 2004.
I had to inform them and they started to withhold the taxes from Jan of 2005.
I would like to know what the procedure is to pay these for the 3 month period from October thru December of 2004.
Any help would be greatly appreciated.

Thanks,
keychey.

Keychey:

Make arrangements with your employer to have the back Social Security and back Medicare taxes withheld from your pay.

However, you have no legal obligation to pay these taxes. That is your employer's obligation to pay the taxes and collect your half from you. If they fail to do so, that's their problem.

Question on tax form

Atlanta Tax Expert:

I received my H-1B from my employer in January 2005 but chose to stay on my OPT Status which was valid till May 31, 2005 since I did not have to pay SS/Medicare Taxes on this status. After May 31, 2005 my employer began deducting the Medicare and SS taxes.

My question is am I eligible to file Form 1040 / 1040-EZ. I have not left the country for the entire 2005.

Your prompt response would be appreciated.

Thank you.
