    9 Months on OPT and 3 Months on H1B will I qualify to claim Making Work Pay Credit
    Hello,

    I was on OPT till Oct 1 2009 then I changed to H1-B.
    I researched a bit and found out that I have to fill in 1040NREZ (Please correct me if I am wrong :)).

    I filled my Federal Tax using Cintax application. And then to cross verify I again filled it with H&R Block, free federal returns.
    Found out that according to H&R block I am getting $400 extra refund.
    That is because it is adding "Making Work Pay Credit" clause for me.
    I searched IRS website that this is what it said:
    Making Work Pay Questions and Answers: General Issues

    Q1. What is the Making Work Pay Credit?

    A. In tax years 2009 and 2010, the Making Work Pay provision will provide a refundable tax credit of up to $400 for individuals and up to $800 for married taxpayers filing joint returns.

    But my question is am I eligible to use this option, because I read that F1 students are not eligible for this. But my situation is different, I am not totally on F1 nor totally on H1. Can someone please help me this?

    If you are single and have not completed 5 years on F-1, you will file nonresident tax return. You will not get Making Work Pay credit. Your U.S. Tax Return: The U.S. Visas

    Thanks MukatA. But I am on H-1B from Oct-1st 2009. Does that help in any way?

    No, it does not, because you cannot file as a resident under those circumstances UNLESS you are married.
