    Wage Garnishment For Married Couple
    My wages are already being garnished by one creditor. And another creditor is going to sue both me and my wife. If I'm already being garnished, can they go to my wife and garnish her wages? And then we would both be garnished. Can that happen?

    In Ontario, Canada, which is not unlike most other North American jurisdictions, a husband and a wife can both be garnished for the same debt (if they were both co-signors) or their own individual debts as the case may be.

    In Ontario no more than 20% of an individual's wages may be garnished at any particular time.

    If the garnishments are causing you undue difficulty you may be able to ask the court to reduce the amount that is being taken off each paycheck.

    If your you and your wife are both on the debt, they can garnish both.

    And if the first one is not garnishing to the max allowed both can garnish your pay also. Up to the max allowed by your laws.

    If the debt is both your names. Its likely they can garnish. I'll almost certain that the can only garnish one person for the debt. I'd check out the federal trade commission on fair trade and collection act. Then I would consult an attorney who specializes in this. If money is an issue there's always consumer credit advocates. They can work with you and help save you credit from any further dips.
