    Statue of limitations in Ontario
    Hello everyone

    I was wondering if anyone could help. I have been served with small claims papers with regards to my previous post on a debt that has been invoiced in Feb/05. I understand that that they can't proceed with legal proceedings after 2 years and it has been that now. I was hoping that someone could point me in the direction as to where I would find a document on the internet that would show this limitation asap. Thank you in advance. Please help.:(

    You have to be careful, it's 2 years if the debt occurred after Jan 2004. The statute is counted from the date of your last payment or the last time you acknowledged that the debt is yours and you intend to pay it.

    Also, the company you owe money to has the ability to ask for an extension, they may have done so. On top of all this, if they began the current legal proceedings in February then they may have made it just in time.
