I have received a summons and I have 20 days to respond with a written answer in terms of the Wisconsin statutes in chapter 802. I have read chapter 802 and I don't understand still how to write the response. I have also called the court house and tried to talk to someone in the civil division and they won't tell me anything. Its already been seven days, so I'm in need to find out how to reply.

Chapter 802 - which I just read - describes the procedure. It does not (nor does any other Statute) give a format or boilerplate form or letter to follow.

What are the general details? Credit card loan, something like that?

What is your defense to the action?

I was not set up as with a user name and password. I did try but nothing happened when I submitted it may have been.

Chapter 802 is generally the same as the Federal Rules of Civil Procedure. What you do is this (in general: Chapter 802 may vary somewhat, but I don't recall that it does):

Copy the caption as it set forth in the pleading ("complaint") that has been served on you.

Then title your document "Answer".

In response to each paragraph of the Complaint, in the same numerical order, Write "Admit", or "Deny", depending on whether you believe the allegations of that complaint are correct. If you don't know, write that.

If you have any "affirmative defenses" (as described in Section 802.2 (3)), write them out.

Finish with a "wherefore" clause, by which you say what you want the court to do (i.e. "dismiss the complaint", or something like that).

Type your name, address, phone number, and sign it above your name.

Send a copy to the plaintiff's attorney, and include on the bottom of your answer a "proof of service" saying that you mailed a copy to so-and-so, and again sign it.

File the original with the court.
