Car accident, not my fault, no police report, have driver info

A driver hit me while I was nannying with 3 kids in the car. She sobbed about her insurance being so high, and she will pay for the damage out of pocket. It has been 8 months now, and not a penny has been received. Luckily she has still been answering my calls. What rights do I have?

File a claim against her insurance company NOW !

Well most likely you will find she had no insurance, never intended to pay and may not have even had a drivers license.

You should file a law suit against her in small claims court.

But being honest, why no police report, you had 3 kids that belonged to someone else, and had a car wreck, do you know the liability you had if for example the next day one of the kids complained of a sore neck or pain,
