Trying to sell our home

My husband and I are trying to sell our home, but the title company found two abstract of judgment liens on it. I have a credit card debt and a nursing home has sued my husband. We had to relocate to San Antonio, TX due to a job and cannot afford the mortgage payment and rent for our rented home in San Antonio. My credit card company refuses to settle for a lower amount, but we cannot sell unless we settle. We cannot afford payments because I do not have a job (stay at home mom to 3 kids). Stuck at a dead end ... help.

I am sorry to say yes you are stuck, they credit card company does not have to settle.

You would have gotten months of late notices from the credit card company, they would have sued you in court ( you would have been served notice) then since Texas does not allow garnishment of wages, they then filed a lien on your home.

So unless you can sell the house for enough to pay off the mortage and this lien, no you can not sell it. Can you work a evening job while husband stays and watches the kids ? can he work two jobs ?

I would say this is something you should have know about and figured when you decided to move.

So short of filing bankruptcy I really don't have a answer for you.
