eviction for someone in my house

i have someone in my house that i need to evict due tosuspected illegal behavior, and they do not have a lease. how do i evict? do i need to give notice?

Go to the magistrate and tell them why you want to evict them. They will take you through the procedure and tell you all the details. I think most states make you keep any of their stuff that they leave behind for a month or so in case they come back for it. So be careful about that.

Each area has their own rules for eviction. Since there is no lease, you have what's referred to as a periodic rental. The period is the amount of time that rent is due (i.e weekly or monthly). Depending on that you have to initially give them notice of one rental period that you are terminating the lease. If they do not vacate by the termination date, then you have to take them to court. This involves giving them a vacate order generally 3-7 days. If they are still not out a court hearing is scheduled and an eviction order is issued. You then take the eviciton order to a sheriff to have then physically put out.
