    Want roommate out - no lease
    I have a roommate I want out. She doesn't pay half the time, loud, brings in all sorts of rif-raf, eats everything (replaces nothing or pays for her own). I am the only one on the lease, she is not. Do I have to give her notice?

    If so how much? She has been damaging my property as of late and I want her out. What do I need to do to make her leave?

    I live in Florida.

    At the top of this forum you'll find the landlord tenanat laws for Florida. It will tell you EXACTLY what you need to do.

    Hmmm... Can't seem to find the Florida landlord tenant laws that you referred to excon. Does landlord tenant law apply to someone if you just are renting them a room on a month to month or week to week basis?

    I live in Florida and am thinking about renting out a room but am afraid of all the legal stuff that's involved. Don't want to dig a hole I can't get out of.

    Hello N:

    Go to the top of the real estate law board. The second post from the top contains ALL the states laws. Florida is there.

    If you are renting a room, you are a landlord and are subject to the law.

    Thanks... I just found it. Safest bet for me then is to make it month to month. That way if things go bad I don't have too long to wait to get roommate out.

    9sammie9 I don't know what the laws are, maybe you can read through them yourself and figure it out. If she's not on the lease, she would have to at least be able to prove that she's been renting from you. Can she prove that she's been paying you rent? Canceled checks? If yes, are they all for the same amount? If no... then you can prove that she breached the contract. Find out what you are allowed to do with a tenant in breach of the contract.

    If she has been paying you with cash, and no utility bills, phone, elec, cable, gas are in her name... and if it's true that her name is not on the lease who knows... you may simply be able to tell her to leave.

    Once again... I do not know the law.
