    Trying to evict a family member
    I am a parent of an verbally abusive daughter who lives in my home with me. She is 35 years of age and resides here also with her 13 year old daughter. I have decided since the situation has been getting worse and I feel like a prisoner of my own home that after 7 1/2 years of dealing with this I no longer want her to live with me. I have asked her to leave and she won't. She pays me 300.00 a month when she feels like it for rent. I have been told that I can not evict her because she doesn't live in a apartment she lives in the upstairs bedrooms and shares the rest of the house with me that I can not have her removed form the home. What can I do legally to get her out! I can not live like this any longer!Please help me!

    Of course you can evict her, give her 30 day notice, and if she does not move out, you take her to housing court.

    My mother is having the same issue. You may want to go back and read the response posts to the situation that I shared: It's entitled: "Family house guest from hell" posted August 7, 2007. The members gave some very good feedback - there's also a link to an article you should read that will give you more insight: Tampabay: Law slanted in favor of unwelcome guests.

    My mother had to contact an attorney to start the process to have her formally evicted. Your situation is a little different given the fact that money has been exchanged for room and or board.

    Who told you that you can't evict her? She doesn't have an ownership in the home. Therefore she is either a guest or a tenant. Since she has paid rent on occasion, she would be considered a tenant. Therefore you can evict her as you would any tenant.

    Maybe if she sees you mean business by starting the eviction process, she will wise up.

    Well, my mother went through an attorney who has begun the process of "evicting" her. My mother gave my sister an official action notice and informed her that once the papers have been completed and the proper action taken with filing in the court system that the Broward County sheriff's office will come to serve AND escort her off the property. So, at this point my mother is just waiting to get the OK from the attorney that everything has been done correctly - "LEGALLY". My sister has lightened up - she's obviously spinning her wheels to try to figure out what her next move is going to be. She wasn't aware that she could be ousted sooner than thirty days. Since my mother removed all forms of entertainment and other items - my sister has had nothing but time to REFLECT - hopefully this reflection will prompt some NECESSARY changes in her character and behavior as a human being.
