My stepdad kicked me out without any notice

i was living in the downstairs from my mom and stepfather for a year. my mom has bipolar and we had an argument, my stepdad would not allow me to come home, without any notice he packed up my stuff and broke a lot of my stuff can i sue him what do i do?? thanks, jessica

Yes, he committed an illegal eviction. You certainly can take him to court for your costs of moving, damage to your property (if you can prove it), etc.

It's easy to prove. You don't live there, and he can't show the court that he gave you 30 days written notice.. You'll win. Just do it.

To expand on Excon's response. Do you have proof that it was your residence? Driver's License, utility bills, rent receipts, Mail addressed to you at that address, etc.? Once you provide proof that the house was your residence, then you need to show that you no longer live there, which is easy. The burden of proof now shifts to him to show that he legally evicted you and that means showing a court order allowing him to do so. Which he obviously can't do. so its pretty much a slam dunk.
