Squatters rights in IL

Change the locks on them when they are not there. There are no squatters rights, The only rights you may have given them was not calling the police and having them arrrested for tresspass the first day you found them there.

Now that is if? They had no key to get in, they had no legal permission to enter the property, and no right or ownership of the property.

If you gave them a key to go in, that will change the situation.

When did you tell them to get out? If you told them immediately after finding out they moved in then they are trespassers. Go back to the police and get them to do their job. Tell them you want them arrested for trespassing. If they balk ask them to show you what law gives these people the right to occupy your property without your permission.

Once they have been arrested, move thir stuff into a storage facility, pay the first month and change the locks. Then give them the bill and key for the storage facility.

I can't find anything specific on squatter's rights for IL but the concept requires people establishing residence for a lot more than 15 days and/or with the knowledge of the owner.

Normally the answer you gave would have helped, but I live in Cicero, IL. The police have told me several times that there is nothing that they can do.

Did they say why? Did you ask them what you have to do to get rid of trespassers? Did you go to someone in authority, not just an officer or desk sargeant.

The problem here doesn't appear to be the law, but the police's refusal to do their job.

You probably can find the Chief of Police down at the local doughnut store. I'd ask him when he finishes his doughnut, to do his job, please. Maybe if you offered him another doughnut.........

I agree with the guys, find someone in higher authority in the PD. How about not mentioning that it's your son? Tell them that someone is trespassing on your property and you would like them removed and you'd like to prosecute them to the fullest extent of the law. (If you lived in TX you could shoot them in "self defense".

) How did they get in to begin with? If they broke in file charges for that, too. If they got a key file charges for theft. Look up IL criminal law and show it to the police if you have to.

Do the trespassers have any money? If not, I'd be tempted to just move their stuff out and change the locks. In order to attempt a case against you based on squatter's rights they need the money to file the case.
