Kicking out a roommate not on lease
Me and my best friend moved into a huge house together. We moved in one of our good friends and things have just not worked out. Her boyfriend moved in and stole from us, we had to call the cops on her for attacking us. We told her that since her boyfriend moved in (for 2 months now) that they need to pay more in rent and utilities, and that we were not happy with the situation. After she decided that she is not going to pay anymore in anything we informed her that if she didn't pay by a certain date that we would consider it giving us her 30 day notice, she is not on the lease and we live in Oregon. She informed us that she will not be leaving and that if and when she decides to that she will gives us a written 30 day. DO we have any right and can we by law just kick her out? SHe never signed a lease or anything. What rights do we have?

If she has proof that she paid rent (check or reciept), she is a renter. You will have to do vacate proceeding legally. Give her a 3 day notice (sample: http://www.utahlawlady.com/freestuff/nuisance.pdf). Then you will have to file a 30 day notice to vacate and file it with the court and sheriff's dept.

One way also would be to get the landlord to give you a pseudo one due to breach of contract, but you may have problems with him/her if they were not aware.

    Good luck
