I live in NYC and rented a property in Southampton this past September. The rules of the lease were that the security deposit ($700) would be returned within 2 weeks of vacating the property (which was on 9/20).
It's already a full month overdue... I've tried to call, email and txt the landlord and was told that it's in the mail... That was two weeks ago. I've requested that the landlord put a stop payment on the last check, issue a new one and send it via Priority Mail to ensure tracking. I haven't heard back (my last request was a week ago).
Can anyone help? What recourse do I have (other than take them to Small Claims)?

I neglected to add that the LL has no recourse to hold my security... The property was vacated in good condition. I have the LL's confirmation in writing, advising that the security deposit will be returned.

In short he will keep your money until you take legal action. If you know an attorney see if they will send a demand letter with his letterhead, it might jolt the deadbeat a little. good luck

I don't know any attorneys... Is requesting an attorney to send a demand letter an expensive undertaking and/or is it worthwhile (gets results)? What are my other options? I want to not only recover my money, but to also make this person accountable for what they did. Not necessarily in monetary damages, but some punishment so that they think twice about doing it again.

Sue him. You'll get your security deposit back plus your court costs. You can't punish him, though.
