| Generally, if the lease agreement has both you and the roommate on it, then neither you nor the landlord can kick only him out.
In an eviction situation, it typically has all resident names on it. Yes, you're between a rock and a hard place. Is it a one year lease?
Here's an angle that I've helped residents do before...but just so you know, the landlord does not have to do this...it's just an option that you might ask him about.
If you move out and return your keys to the landlord, then you no longer live there. He could file the eviction against only your roommate. |
