Family Roommates need to go. Help

I live in Texas and I caring for my disabled sister. Her son, (My Nephew) and his wife and 2 children are living with us. They are listed as occupants but the lease is all in my name. They are causing grief and arguments all the time. My nephew just quit his job and now I have all the bills to pay. They are there on an oral agreement and pay half the bills (Usually Late).

My question is do I have to give them a 30 day notice to vacate or will a 72hr notice suffice. Rent is paid thru December, but they will not be able to pay on the 1st of January. My sister wants them gone also. Really need some good advice. Thanks.

Hello gf:

If they pay rent (or bills - even if late), they are considered month to month tenants and have to be evicted. If you think they'll leave with a 30 day notice, I would do that. If not, follow your states rules for eviction. You can find them at the top of this forum.

Most eviction processes begin with a 3 day notice. That might get their attention.
