if you own a house and on the bank paper work it says its your primary residence, then what happens if you don't live there and you are evicting the tenants that live there for non payment because they were still there from the prior owner? we are going to court in august and i have not been able to collect rent from them. they think the house was in foreclosure and it was not. i asked them to leave on several occasions and they ignored me. they put the heat in their name and claim i owe them that money. what can i expect when i go to court? i had four different tenants living in the house and it was so hard to reach them, and financially i could not afford a lawyer. in march i started to go to court and two of the tenants have left. the other two refuse to leave.

most likely them not even showing up.

But you need the deed to merely prove you own the property, The tennant may beside to report that you don't live there, but unless you are getting some special loan for a resident only, that should not be an issue.

And you can't be a resident untill you evict can you. You should have give them a notice the day you owed it, and you need to file in court when they did not leave to start with
