    NJ - Lease Break before Move In
    Hi,

    I signed 1 year lease for an apartment unit on March 10, 2007. I was suppose to move in on April 1st, but I sent a lease break notice on March 20, 2007 as my work location was changed.

    I have paid for April rent and looks like the until will not be rented for few months. I requested the landlord to let me out of the lease considering that I haven't moved in. But he said he has already done me a favor by not charging the re-rent prcoessing expenses and I should not expect anything more.

    My employer is willing to pay for only one month rent (April).

    I was wondering, if there is a way out of this for me. My securiy desposit is still with him.

    You lease was binding and the landlord could charge you rent for each month it sits vacant, until the unit is re-rented plus and advertising expenses. If he allowed you to walk away with only lossing your security deposit you did get off light. Will your employer pay the security loss which is equal to a month's rent? You may have broken even.

    Yes you will have to pay the rent ( and in some cases keep the utility on in the apartment) but it appears they are not requring you to keep utilities on. But until they rent it out, you are obligated to pay.
    Unless of course there is some clause in your lease that says differently
    ( we can't see a copy of your lease agreement)

    This is why a lease is dangerous if you don't know for sure you are going to be livingin one area, but also it protects both the landlord and the renter from changes in the agreement for the period of the lease.
