Is this how to evict a lodger tenant?

Ok. I would believe my tenant qualifies as a lodger. Here are the facts. I am in California.

1) I am the homeowner
2) He is the only other person residing in the home besides myself, there is noone else.
3) I do have a signed lodger agreement dated Dec 18 2007, which both him and I have signed and clearly indicates his lodger tenant status.


He has endangered the safety of my neighbors, possessions and entire home as a result of his drug abuse and negligence. I initially thought he would clean himself up, get a job but he has done absolutely nothing to better himself. I need to protect my property and the surrounding neighbors because, if he should start a fire while passed out or leave the doors wide open and the house unattended like he has in the past, I am the one liable here.

On February 11 2008, I served him with a notice to vacate the room. I did site his negligence and drug abuse, in the letter. He is on a week to week lodger tenancy. If he does not leave by next Monday, what are my options and have I covered all my bases? Should I notify law enforcement prior to that date? Any help is greatly appreciated. Thanks
