    Who will the property be transferred to? A surviving spouse? A beneficiary? A former joint owner?

    This needs to be presented to a Judge with a copy of the death certificate at the time the will or estate is probated.

    Not if it was held jointly - in NY, at least, then you just need proof of death and you can Deed in just the survivor's name.
