going to court again

my landlord raised my rent 200.00 i was paying 1200.00 a month i am sick with a chronic disease and my son lives with me , i have lived here for 4 year and every year before he has raised my rent 25.00. He has had me to court 4-5 times for late rent ( i always paid within the month it was due) he constanly calls and write me letters. He has the people living around me watching everything i do and report it back to him. Last time we were in court I signed the court papers that I would pay the rent due and sign a new lease at the by the 26th of the month I asked him if he was going to raise the rent and he said no. but when I got the new addendum to the lease he raised it 200.00. i had to sign it or vacate by the end of the month. Is that lease legal and binding or because he did not give me the proper notice null and void????? thank you

If he has filed an eviction then it will be up to you to go to court armed with info. It will be all about whether your state has a maximum rent raise amount (it probably does not) and how you are to be notified about a rent raise. If the answer to the first question is "no" - and the landlord gives you proper notice of the rent raise (which is probably 30 days) then you will be evicted.

I'm not saying it's all "right", but in general, when lease periods are up landlords can generally raise the rent as much as they want - then the ball is in your court to accept it or move.

There should be an agency on the state or local level you can check with to determine your rights. But a raise of less than 20% does not seem out of line. But it does seem as if the landlord is trying to get you to move. You have now signed the lease, so you are now obligated, but I suspect he would let you out if you find a new place.

Another possibility, is some negotiation here. Apparently he is unhappy at your tardy payment record. Maybe if you promise him that you will pay on time if he reduces the rent but allow him to raise it if you are late. If he agrees to that get it in writing.

If you did not... look for a more peaceful place or purchase a home...us a home marketing service...they specialize in situtation similar to yours...contact the Better Business Association...What state are you in? Paying 1200 dollars a month is a good monthly mortgage payment...
