gettin an exboyfriend to move

My boyfriend moved into my house in June of 2006. He does not pay rent, only child support every two weeks. We have not been getting along and I have asked him on several occasions to move. Do I have to evict him? He lived here in 2001 to 2003 and moved out so he still occasionally gets mail, but nothing else has his address as mine, he still uses his old address. How do I get him out, if i change the locks and put his stuff outside can i get arrested?

In many states your BF has established residency in the home. All though he is not contributing to the rent he is a resident and you would need to evict him. Some states will allow a 30 day notice to vacate. You won't get arrested but I would be cautious about his reaction. You might be wise to have the Sheriff be present during the eviction.
