Florida eviction

my wife and I have recieved an eviction notice from our landlord for non payment of rent. My wife broke her leg and is out of work for at least 6 to 8 weeks. We do not like the apartment we live in and are looking to find another place.

We have found another place to live but we still have this eviction notice hanging over our heads. The landlord just told us today that the 24 hour notice will be deliverd by the county sherriff on Monday. What would happen if we vacated the premises on Saturday. The eviction notice clearly states pay rent or vacate. can I legally just pack up and leave without any further action by the landlord to demand payment. I'm afraid if I tell the landlord we are moving to another place she might lock up our stuff in the apartment and continue to take us to court for the one months rent that we owe.

Yes move on Sat. No, do not tell the landlord.

But you WILL owe the any back rent up to the offical date of eviction. The landlord can sue you for that amount.
