we rent a house, my fiance was on a 12 foot ladder cleaning out the gutters which had a lot of debri in them, causeing the drain pipes from flowing freely, the ground underneath was gravel, he fell off the ladder and landed on his feet causing his back to be compressed. He suffered from a fractured vertabrae, Is the landlords homeowners insurance liable for this.

I cant imagine it would be. Was he using the ladder properly? Did the landlord ask him to do it? It sounds like an accident, not the fault of the landlord, so I wouldnt imagine the insurance would pay up for it.

Sadly, it probably will although depending on your state it might be up to your renters insurance.

US courts have proved time and time again that it doesn't matter how stupid the person is if they get hurt on your property you have to pay them even if they were robbing you at the time.

Probably not, unless the ladder was the landlord's property and is shown to be defective.
