Security Deposit on Rental Property

My daughter paid a security deposit for an apartment in Pennsylvania while she was living in Texas, sight unseen. it was promised to be immaculate. when we looked at the apartment it was dirty, broken windows, dead bugs, the works. the landlord is refusing to give back the security deposit, even the $250 pet deposit. is this legal? she signed no papers, leases, etc.
