Eviction of a relative, FL

Hello,

Hopefully someone can answer my question.

My father is 70 and my adult sibling is living with him, she refuses to pay rent or help around the house. He has asked her to move out on numerous occasions but she refuses, she has told him that if she stays in the house for 24 hrs. straight that means she cannot be evicted. Please help me find a way to help my dad.

Thank you

St. Petersburg, FL

Hello wce:

Well, if she's NEVER paid rent, she's probably legally considered a trespasser. All your dad has to do is change the locks.

However, if she's EVER paid a utility or a dime of rent, then she's a tenant, and has to be evicted. That's no big deal, aside from the family trauma.

24 hours straight means she can't be evicted????? Bwa, ha ha ha. That's a good one.
