Eviction in California

I am late on my rent and was served a 3 day or quit letter. I called my property management people and told them that I can pay this weekend with a chashier check. She had threated evition on me. I called and left a message for her but she has not returened my phone call.

What I am asking is if I have the rent and can pay it, what will happen if they chosse to start eviction on me. Do I have a chance to pay up. Without getting evicted.

They can refuse the payment and evict you - at least in NYS. You have - apparently - broken the terms of your lease. Your rent must be very late if they've already had time to file the papers and serve the 3 day notice. The fact that your phone call has not been returned would indicate to me that they don't want to talk to you and plan to go through with the eviction process.

I meant to add that it is already the 29th of the month and management is probably concerned that even if you come up with March's rent this weekend (the 22nd) April's rent is due 9 days after that and they are questioning whether you'll have that rent on time.

Once you've broken the lease they don't have to work with you. They may be willing to try to work it out rather than evict you, find a new tenant and so forth - but the fact that they will not return your calls probably means they are not interested in negotiating with you.
