Evict a california roommate

Asked Feb 28, 2008, 11:48 AM — 4 Answers
I have a roommate that must go. He doesn't pay any portion of the rent nor utilities and never has. Will not leave when I ask him to go. If anyone needs more info than this please ask for it. Will a 30 day CA eviction suffice or do I need to have the landlord process this. I'm hoping that I can do this myself. Tyou!

The key here is whether he's on the lease or not. If he is then your landlord has to process the eviction. If he isn't then he's your tenant and you can process the eviction. Either way, the formal eviction process must be gone through.

This may sound odd to you but I'm not sure if he is or not and the reason for this answer is this. A new management team took over from the owner and I signed the new agreement but I'm not sure about him. He did not sign my agreement but he may have been cagey enough to request one for himself when I wasn't present. So, from the sound of things I may have to contact the mngmt and get this answer. Hmmmmmmmm, I was hoping this would be a simple 30 day request from me. Tyou. Any other help will be accepted.

First, any notes posted to the thread can be viewed by anyone.

You've already asked this guy to leave so why do you think a 30-day notice will work? You will probably have to through the hearing process to obtain a court ordered eviction. But, again, if you aren't the landlord, then you can't evict.
