ok the situation is that my landlord did a suprise inspection on my apartment staeing that i have more people in my house than are on my lease. i had a couple of friends that stayed the night before the inspection to baby sit my children while i was working at the hospital(my job), and i am a single mother. i work long hours and am lucky if i get two days a week off. when they did the inspection my sons were in the tub and i had them wait outside untill i had my boys dressed (they were running around ) she started to bang on my front door and screaming that she was to be let in. after i finally had my kids dressed she went off on me that i'm lucky if i'm not evicted cause she had to wait. I let her in and she snaped her photos. I pointed out a whole that was, made by accidient when a friend triped over my tool box while joking at the b day party i threw (10 friends were over), in my wall that was just made two days ago and i had already pad to have it fixed and was half way done yesterday. She took photos of my dishes I made the other night when I threw my friend a b day party in my sink that I had not finished washing. and my boxes that i had just started packing since my least is up in the end of Sept. I put a ciggerit can out side for those who come over and smoke and she yelled at me about those and other on the premisises. I told her I quit smoking a long time ago and thats why i put that out there for others who come over. I just moved new coauches in my apt. last nite at 9pm and put my old cauch out side to be taked by the dumpster which i called trash company for to be picked up roght before my landlady showed up.

She left then came back an hour later and served me an evition notice for damage to poperty. The damage she caimed is from the the whole in the wall and the stains in my carpet from juice, spilled milk, and everyday traffic with kids. It has only been 2 months since i last steamed cleaned my carpet due to my work sheldule. I was getting ready to do it again this sat, since it's my first weekend off in 2 months other then the one day a week I get for working four 12hour shifts plus i;m on call 5 to 6 nights a week for surgies.

I would understand the eviction if I had paint, ciggert burns and stuff that was not removable done to the carpet of if i had muiltiple hole all over my apt due to me hitting the walls when mad and not fixing it. BUt I had one and it was half way fixed already!

Do I have any rights? Is this legal to put me out and my children? Can fight this? It does not say anywhere in my lease they can do suprise inspection on me only querterly.

Can I file for an extenstion and if so how?

They gave my 7days to get out and they changing the locks. I have no where to go and i have a 4 and 6 year old son.

I never had a problem with them before and i have always let them know my situation since i moved her.
