    Am I liable for lease which I did not sign or my name was not mentioned in?
    My boyfriend and I leased a granny flat to which he signed the lease; I did not sign any documentation. He passed away just before our lease ended. I advised the lessor that I was terminating the lease and not taking another lease with them as I could not afford the rent on my salary alone, he was fine with it as he knew my predicament.

    The granny flat had a problem with the entrance door if you locked it you couldn't open it so we didn't lock it at all when I moved out it was very late so I took the key with me as the door was open for them to enter. He now wants to sue me for one months rent. Secondly, there was a leek by the taps in the kitchen of which we advised him of he did not fix same, the cupboards became damaged from the leek and now he wants to sue me for R8500.00 damages for the cupboard.

    What I need to know is if I did not sign the lease or any other documentation concerning the lease am I liable for any costs to the premises or the one months rent that he wants me to pay?

    The part about not locking it when you moved out was garbled, but I don't understand how he figures he is owed a month's rent because you didn't lock it.

    No, I don't expect him to be able to prove that you (rather than your late BF) caused the water damage associated with the leak. And, as I say, I don't understand how he figures you owe him a month's rent after you moved out.
