    3 Day Evicition Notice St. of Florida
    My sister just received a 3 day eviction notice because she broke her foot and is out of work for at least 3 weeks and behind on rent. With 2 children (1 under 2) what are her options? I believe this was served yesterday and she signed it but did not obtain a copy of the document.

    I am not an attorney but in Florida a 3 day notice must be either hand delivered to your sister or posted on the door. If she signed something the landlord must have paid to have her served and in any of the cases I mentioned she would definitely be left a copy. When the 3 business days go by and she has not paid the landlord can file for eviction. Your sister's choices are to pay what is owed, get out by the 3rd business day, or be evicted. The eviction can follow her regarding rent and credit history. Each county in Florida take a different amount of time to go through a total eviction. I hope your sister has picked up the phone and called the landlord/management company and has not been ignoring her problem. Many times a little communication is all that is needed to work out the situation.

    As sharon noted this is the initial step in the eviction process. She needs to read the notice carefully. Its probably not an eviction notice but a notice to vacate. An eviction requires a court hearing. If she doesn't vacate, then eviction proceedings start.
