| Paid in full - seller didnt deposit - 13 months later they want money. So Last April 4th 2008 I bought a horse trailer. I paid part cash and part check, I have the entire filled out Sale of Contract which states the amount due and that we paid in full. I have the title registered in my name and the registration in my name - no leans. It also states that the amount due must be paid by the due date, which was the day we bought it. The company recently was bought and apparently has a better business management dept. They claim that they found a check from us that looks like it was supposed to be voided, it was never signed etc. I remember and so does my husband that this cleared the bank. The bank records on this are over a year old and are archived so they won't give me a clear answer on whether or not it did go through. Because neither one of us can prove or disprove the facts can they force us to pay again. Isn't there some sort of statue of limitations on things like this. Its been 13 months already. I know on checks they are only good for so many days and after that its just a loss. Since everything is already in my name and they cannot prove it either way do I have to re-pay them or can they sue me if they want to. Everything is in my name - nothing tying them to the trailer...aargh! I don't know what to do... |
