A private investigation

I know someone can help me.I have a legal matter that needs some experienced intervention.I have a summons that needs to be served and the person is playing hard to find. I have all his information.I get a process server to do some background check and also to serve him. I would like to know the statue of limitation on how long i can pursue this matter.
l vow never to give up. I try to help some one in need during a crisis and he choose the dirty way out.His girlfriend got pregnant and his father died during the same time. He swore up and down how she trapped him because she want her permanent residency.He begged me to loan him some money to help out with his crisis at hand. I did not at first because money always breaks up friendship. He swears he will pay me back in installments from his pay , then he said he will pay me from his tax return; no payment . When i confronted him he said he sued the state of Florida so I have to wait until his lawsuit comes through.I searched for him on google.com and he does have a lawsuit.
Please can someone help me any way they can!!

Statute depends on the State you are in.

It is possible to get a Court Order to serve at his last known address but you need lots of documentation.

What is the dollar amount? I don't think Small Claims in most jurisdictions allow service at last known address.

Hi ,finally someone is responding to me. the dollar amount is $5,500. This happen in New York. When the sheriff went to serve him he moved out overnight.I ask the clerk about the statue of limitation where she inform me it is 6 years.YOUR ADVICE IS GREATLY APPRECIATED. I was just trying to help someone in need.

There are PI in various areas that specialise in service. Finding him is all a matter of how much you are wiling to pay, it is not cheap. Most attorneys have firms they perfer to do legal serivce with.

Won't the Sheriff locate him and serve him? You can hire someone privately to locate and serve but if the Sheriff has already made an attempt I would stay with him - there must be a reason the Sheriff was assigned this in the first place.

You will also need Affidavits of Attempted Service if you decide to serve by publication, nail and mail, whatever you can get permission to do and it's best if they are all from the same place - I believe you need 3 good attempts (3 different days, 3 different times) or proof that "he" has moved.

Thank you very much for your advice. I am in the process of doing exactly what you said to me so it will be appearing in the paper soon. I am trying my best to do everything I can.

JudyKayTee agrees: Good - hope it works out. The advantage of the Sheriff is if the person they are trying to serve is avoiding and burning up their time they get an attitude - and then they make sure the papers are served!

You can file a lean on the open law suit, when final you can collect your debt. The law firm has to pay you first befor the client.

The OP has to serve the debtor first, go to Court, get a Judgment and THEN lien against the lawsuit. That's some distance down the road - the last I heard she was trying to get him served (which is step one) and was not having much success.
