Vacation Pay Deductions

Can an employer deduct accrued vacation from a salaried employee when they call in sick? There is no sick pay at this company and there is no specification in the employee handbook.

Vacation pay is a benefit given by the employer to the employee. Thus the employer may say when it may and may not be used.

Salaried exempt must be paid if they are out a day sick. The Department of Labor does not care from which pot it is paid. It is legal for the company to use vacation pay.
