I need to get copies of my paycheck stubs and timecards stating when I worked and how much I was paid from my employer in 2008; she is refusing to give me them so my question is can she do that legally?
This depends on which state you live in as different states have different rules on records and what must be available to the employee and for how long it must be available.
You can call your local Department of Labor and recieve this information.

I did call and was told that I have the right to view and make copies of my personnel file. I told that to my former employer and she is saying that my timecards are not in my personnel file- I would like to know where she is keeping all this stuff. She has been very hard to deal with in this matter...
First it is very likely they don't have the time cards. Is there a reason, like do you believe they are cheating you on your tme ?? I f so you may get them as a request for evidence.
The company should supply you a print out of your hours and times
