Incorrect W-2

my ex-empolyer did not pay me for 8 weeks of work for 2006. Now, I get a W-2 showing he paid me. I have a claim in with the labor dept last year but they did nothing, well they made a phone call but that was it. I have a copy of the only check they did give me for 2006 and it was returned for insufficient funds. Besides that I was never paid for the 8 weeks I worked. I called the IRS they said that I have to wait until my ex-employer submits his taxes...what are my rights? and how do I fix this?

You need to take them to court and don't represent yourself. Get a good labor attorney.
