    Hsbc & phone calls
I am so aggrevated (pulling hair out). We have a second on our house from hsbc and owe for may 2008 payment. I have spoken with reps. On days & times letting them know that due to the shooting deaths of my 2 children I would not be making a payment at this time due to burial costs. This company continues to call me daily and no exaduration every 46 minutes (thank goodness for caller id). When I spoke with a rep. tues. night which was same woman on Monday night she gave me 2 different dollar amounts so that frustrated me also. I understand they are trying to make a collection for what is due but come on I can't take much more of this. What can do for a little easement?

Thanks for taking time in reading and possible return contact.

The following link will take you to the FDCPA.

This link contains all of your legal rights, and the laws that collection agencies must obey.

Some states have initiated this federal law, to apply to all collectors, even though the act itself is applied to third party collectors, not always to a company collecting it's own debt.

Read through the act, highlight the areas that you feel they are in violation of, and point these laws out to them the next time they call.

First may I offer my condolences on your loss. I agree with Progunr but I might take this a step further. I would write them a letter stating why you would be unable to pay this month and asking that your loan be extended one month under the circumstances. In the letter I would also insist that any future correspondence be by mail. I might also consider dropping some hints about how the press might like the story of them harassing a mother who just lost her children through such a tragedy.

I would also like to extend my condolences.

I agree with Scott 100%. I would hope that they would make an exception in this situation, but I probably wouldn't spend a lot of time worrying about it. Let the chips fall as they may right now and concentrate on your family.

Once this is all over, and if your credit reports are showing late payments, send a letter to them (call and ask for an address and who to address the letter to) including a copy of the news story, etc.

If that doesn't work, post here again we'll give you a couple more ideas...

    Sorry again!
