What does sending a cease and desist actually do?

I have been told conflicting stories about cease and desist orders.

1. I was told that a) sending one stops the creditors from harrassing. b) requires the debt to be sent back to the original creditor c) stops collection activities.

2. that it usually makes the creditor upset enough to sue you.

I have a few debts that are in the process of trying to be settled and the company i hired to negotiate the accounts has sent these documents to the creditors that haven't sued me yet.


Does anyone know if this could hurt me?

I trust this company and they charge very little in comparison to other companies, but i am scared....

Debt consolidation companies???? I dunno. This is important stuff. What they do will impact you for a LONG time. I wouldn't trust 'em just because they're cheap. As a matter of fact, I might distrust them BECAUSE they're cheap. They're negotiating for you. You could do the same thing, free. Hopefully, they're negotiating with the companies who HAVE sued you too; otherwise it's kind of a waste.

The "Fair Debt Collection Practices Act", doesn't use the words "cease and desist". What is says, is that if you notify the collecting agent that you don't want to be bothered by letters or phone calls, they must stop. That's all. Of course, the only alternative they have left is to sue you.

Does that upset them??? Not getting paid upsets them worse, and who cares anyway? Will that cause them to sue you??? NO. Whether it's WORTH it for them to sue you is the determent factor. But, they're not gonna sue while they're talking to somebody... Unless of course, you owe jillions.

Will this hurt you??? I don't think so. NOT receiving phone calls from those scumbags is a pretty good thing.
