    Toshiba Laptop Malfunction. Do I have a case?
    I don't quite understand how this could have happened. I took the la[ptop a couple months ago to Best Buy for some work. They said more needed to be done with it. It came back 3 weeks later. I lost valuable school time, and failed a class because of it. That's not the reason I'm writing. I work security, and I use the laptop overnight in my car. I was sitting in my car, and noticed the screen was hotter than usual. It actually would burn my hand of I touched it. I went to do my patrols, and came back. I sat down, put the laptop on my lap, and noticed the screen was turning brown in the LCD part. It hissed, and made bubbling noises. I looked in the back of it, and saw the LCD was actually melting down. I NEVER SEEN THIS BEFORE. Sure,I've heard of batteries melting down, but not screens. I looked back at the LCD, and POP! It did a minor explosion with no visible flame, but sent either rubber, or LCD liquid into my neck as I turned away. It could have been much worse, maybe my eyes. I have a couple burn marks from it. My laptop is totally a mess. I have to go to the doctors because now I cannot get over the fear of LCD screens. I work with them, and couldn't return to work because of this fear. It's terrible. I don't know who to blame. Best Buy, or Toshiba for the problem. There was nothing around that could have caused that. The laptop is not fully destroyed. The LCD part is, but the computer still turns on. I really don't even want to fix it. Im deathly afraid it will happen. It may happen to someone else, and cause worse injury than it did me. Do I have a case? I should note, that if this burn does scar, or anything like that I want to sue them for more. I am in Central Casting, and waiting for their calls on movie roles. I have a spotless neck, and I am a young 22 year old guy with great ambitions. Look at what I do.

    I'm not the ordinary guy. I have things I want to do in life. My photo of my neck if scared, will never be the same. I don't care what kind of a scar it is. Thanks, and I'll be home from work most of the week till I figure out what I am going to do.

    Hello Kevin:

    I'm thrilled that you have a spotless neck. However, most people have spotless necks, so I don't think that's going to add to your claim.

    But, if that Toshiba blew up and hurt you, you absolutely have a claim! Who cares who it's against, Toshiba, Best Buy, the trucking company who brought it to you, the web site where you tracked the shipment, the MacDonald's you ate at the day you ordered it.

    Nahh. I'm just joshing about MacDonald's. But the bottom line, is you let your lawyer decide who to sue. Did I mention lawyer? Yeah, you need one. Call a few up on the phone. You'll learn a lot, and maybe you'll find one who will represent you on a contingency basis. That means it won't cost you anything unless you win. If you DON'T find a lawyer that'll represent you on a contingency, you can't afford to hire one to do it - so you're out of gas.

    DON'T mess with your laptop AT ALL! Leave it alone. IF it's evidence that THEY'RE at fault, you COULD ruin that evidence!!

    You sue everyone, the manufactor, the dealer that sold it to you, the clerk that sold it to you and more.

    First of all, how long you have been using the laptop? Is it within the Standard Limited Warranty of Toshiba?Because if it is, you can file a complaint to their Corporate Department because they are producing Bad Quality Laptops. Second, if you had Best Buy repair your computer and not Toshiba because the warranty of your computer has already expires then they are the ones you need to talk to regarding this issue since the overheating issue and the melting of your LCD happened after you receive your laptop from Best Buy.

    Right, it's true - Fr Chuck only posts the truth. No time for posting false info.

    If you sue one (Best Buy, for example), they will bring in the manufacturer. Let them fight out who caused the problem. Better (obviously) for you to name both of them but naming one and having that Defendant bring in the other is always an option.

    A lot will depend on the amount of your damages - Small Claims Court is probably a good option. If you are thinking of arguing a failing grade and fear of computer screens I think you are going to lose.

    I have seen one of these cases - the computer screen cracked, the owner sued and lost because the instructions say the laptop MUST be on a solid surface so that the heat will dissipate and the manufacturer proved that heat buildup caused the problem. I also use a laptop when I work and have a plexiglass flat sheet/base that it sits on, even when it's in my lap.

    Yours sounds like a different scenario.
