    Subpoena for someone else
    Someone just handed me a subpoena for someone else who lives with me (my fiance). Can they do that? They told me to call him and tell him he has court on Monday when I told them he would not be back until Tuesday!!

    Do I have to track him down?? :eek:

    Depends on the legal service rules of your state. For some all that is required is posting it on the door, in others handing it to someone in the household.

    Since the court will assume by the servers statement that legal and proper service was done, there will be a court case with or without him,
    So if you care for him you had better tell him so he can be there.

    I am in similar situation,
    The attorney left the subpoena with my neighbor to give me.
    I was wondering if that was legal?

    Do I have to go?

    I want to say NO but being wrong could cost you jail time. How unfair!
