Is it legal for the principal to go through your phone and look at all the text messages and the phone book etc?
K heres how it happened:
On Monday March 31st I got my cell phone taken away because Trevor (bf) handed it to me in class and then I put it in my pocket and the teacher saw it, so she took it away then the principal called my mom tellin her that i got my cell phone taken away so i said it was Brendans (friend) and then she went and looked through the contacts and she said that it wasnt his, which is correct and he said it was his so then on Tuesday his Mom came in to get the phone (because the day before she told him that he would need a parent/guardian to come get it) and she didnt give it to his mom , and the principal told his mom she'd call us down sometime that week she never did so on friday 10 mins before the end of the day Brendan went to her office (and before we made the story that it was my SIM card it was just in his phone ) so she told him that i had to prove somehow that it was my SIM card n I went and asked her and how i was supposed to prove it was my sim card so she said to go find it in the phone (which btw there is no SIM card veiwable in the phone) so I just told her that I have no clue where the SIM card is cuz the company put it in there not me, so she said she would call both of our moms and she never did over the whole entire weekend.
Nows she has had the cell phone for a week and I was wondering if i could ever just claim it as theft or what?
Is it legal for her to use the phone and go on the internet on it when it costs?
No it is not legal for her to use your phone or go onto the internet without the responsible parties permission. The responsible party being whomever pays the bill. If you could prove that she used the phone and used it to get on the internet while in her possession, that should be theft of services I would think.
I dont give a if I broke every n rule in that school! Thats not what im n askin to begin with I'm askin if its legal? Not which n rules I broke, or how im gonna get the phone bcuz I already have it figured out how im gonna get the phone back and I never n asked u guys how to get the n phone back I asked if it was legal for what she was don wit the phone n the school policy was if its ur 1st offense on getttin the phone taken away then they are supposed to give the phone back after school but she's ahd it for over a n week and either n way whether the school approves of it or not I will get the phone back which btw is none of ur guys business n another thing I dont wanna n hear another n word from u parents abotu what u would do to ur children if they got in this situation bcuz I dont give a what u would do about ur children there yours n I wud liek to keep it there cuz its none of my n business plus i dont give a about what u do for your childrens discipline so just to save urself the trouble dont even bother sayin ne thing abotu ur children, that i broke the school rules, or ne other n thing i dont ask about basically bcuz i dont really give a n its wouldnt be the 1s or last school rule ive broken

Is it legal? No idea. Was it "legal" for you to have the phone in the first place? Doubt it. Bet you weren't supposed to have it in class.

The problem with your question, chevy, is that a lot of it depends on what the school policy says about having phones in school. None of us (including you, apparently) know this policy inside and out. But beyond that, you have complicated the situation further by lying to the teachers and administrators.
Can you have her arrested or sue her for theft? No. Can she go on the internet for her personal use while she has your phone? No. But if she does, do you have a case in court? Probably not.

With such maturity and eloquent speech, why don't you simply plead your case to the principal? I'm sure he/she will see it your way. /sarcasm
Whether something is legal (or not) is for a judge to decide. That would require the person who was harmed (e.g. an adult and the owner/bill payer of the phone) to file suit against the individual and/or the school system. You'll have to get your parents involved sooner or later. Sooner is always better in a situation like this.
All I can say is WOW. Please don't waste our time if you have no intention of listening to our advice. Grow up, stop lying, stop breaking the rules and then you'll be okay. Next time you get into a situation that is entirely your own fault, figure it out yourself and don't waste our time. REALLY, it's time to take responsibility for your own actions and stop blaming everyone else when the fit hits the shan. Grow up!
