School and Cell Phone Policies

Is it legal for the principal to go through your phone and look at all the text messages and the phone book etc?

K heres how it happened:
On Monday March 31st I got my cell phone taken away because Trevor (bf) handed it to me in class and then I put it in my pocket and the teacher saw it, so she took it away then the principal called my mom tellin her that i got my cell phone taken away so i said it was Brendans (friend) and then she went and looked through the contacts and she said that it wasnt his, which is correct and he said it was his so then on Tuesday his Mom came in to get the phone (because the day before she told him that he would need a parent/guardian to come get it) and she didnt give it to his mom , and the principal told his mom she'd call us down sometime that week she never did so on friday 10 mins before the end of the day Brendan went to her office (and before we made the story that it was my SIM card it was just in his phone ) so she told him that i had to prove somehow that it was my SIM card n I went and asked her and how i was supposed to prove it was my sim card so she said to go find it in the phone (which btw there is no SIM card veiwable in the phone) so I just told her that I have no clue where the SIM card is cuz the company put it in there not me, so she said she would call both of our moms and she never did over the whole entire weekend.
Nows she has had the cell phone for a week and I was wondering if i could ever just claim it as theft or what?

If you have a recent cell phone bill that shows the cell phone's number on it your mother needs to take that to the Principal's office so she can claim your phone for you if you want this phone back. You might not get your property back until after this school session is over - depends on the school's policy of confiscated items. Prove it's yours and you should get it back. I won't lecture you on the fact you should leave your phone in your locker and not take it into class....but that's another story. I think you've learned that lesson well (or should have). Lying about just whose phone got you in more hot water than admitting it was yours.

MOWERMAN2468 agrees: yes, the policy should be followed. i think the children should be allowed to carry the phones, but turned off, unless there is an emergency. Lying did cause more trouble also for her.

Let me see you had your phone out in class, I will lecture you for having it at school in general, but not leaving it in a locker but having it in class.

So perhaps this will be a lesson learned to not doing this, and yes I would have my parent go out to get it.

MOWERMAN2468 agrees: I agree with the child having the phone in a purse, pocket, book bag, or somewhere, and should not be on unless there is an emergency at the school involving the school as a whole.

And I will lecture not only about having it in class but then lying about it and blaming a third party.

Does this have anything to do with your question about how to beat a lie detector test?

If that's school policy, that's how it is. Maybe the school has discovered the only way to keep cell phones out of the classroom is to confiscate them and give them back at the end of the yar.

And, no, it wasn't stolen and, yes, the principal had the right to look through it.

If you can prove she is using it for her personal purposes go to the Police and file a report. It's theft of services.

Stop worrying about your phone and concentrate on your English class. Punctuation is important.

Have you told your parents the phone was confiscated? Do your parents know you broke school policy then lied about it?

If my kid pulled a stunt like this he wouldn't need to worry about the phone because it would be turned off.

Alll i was askin was is if it is legal n u people keep givin g me this bull about what u wud do to ur child well im not ur n child so get over it All I wanna know is if it is legal for the principal to do these things not whether ud take ur child n phone if this happened to him or her

Omfg, get over the fact that you broke school policy, got caught, lied about it, and have now gotten yourself in a situation where you need to confess your wrongdoing and act like an adult!

Tell you parents the truth, and have them contact the school to see how (or if) you can get your phone back - that's your only option at this point. You don't get to sue people just because they have done something you don't like, especially when you broke the rules in the first place.

Grow up and accept responsibility for your actions.

I dont give a if I broke every n rule in that school! Thats not what im n askin to begin with I'm askin if its legal? Not which n rules I broke, or how im gonna get the phone bcuz I already have it figured out how im gonna get the phone back and I never n asked u guys how to get the n phone back I asked if it was legal for what she was don wit the phone n the school policy was if its ur 1st offense on getttin the phone taken away then they are supposed to give the phone back after school but she's ahd it for over a n week and either n way whether the school approves of it or not I will get the phone back which btw is none of ur guys business n another thing I dont wanna n hear another n word from u parents abotu what u would do to ur children if they got in this situation bcuz I dont give a what u would do about ur children there yours n I wud liek to keep it there cuz its none of my n business plus i dont give a about what u do for your childrens discipline so just to save urself the trouble dont even bother sayin ne thing abotu ur children, that i broke the school rules, or ne other n thing i dont ask about basically bcuz i dont really give a n its wouldnt be the 1s or last school rule ive broken
