Rules for Subpoena

There is a debate in our office about subpoenas for Medical records. Can the medical records be charged for? (i.e. copying cost, labor time, etc...usually not to exceed 25.00) And secondly, does there have to be a release of medical records form signed or does the paperwork that the patient signs to hire the particular lawfirm (which includes permissions to get their records) superceede the need for a separate medical release form. Thanks in advance for your input. - Penelope

depends on what state you are in, but the sure fire way to get records cheap is always to send the client in to get them. There are cases in every jurisdiction regarding "copying fees", "search fees" etc. But I only know what the NY ones say.
